MaterialMotion Inc. ("MaterialMotion," "we," "us," or "our") is committed to protecting the privacy and security of the information we handle. This Privacy Policy describes how we collect, use, store, and share data in connection with our marketing website at materialmotion.ai ("the Website") and our intelligence infrastructure platform for scheduling, logistics, and communications intelligence ("the Service"). This policy applies to visitors who browse the Website, business customers ("Customers") and their authorized users who access the Service, and governs the handling of data submitted to, collected by, or processed through the Website and the Service.
2. Data We Process Through the Service
In the course of providing the Service, we may receive and process the following categories of data on behalf of our Customers: Operational and Logistics Data — including dispatch schedules, delivery routes, load details, order information, job site locations, vehicle assignments, and related operational records. Contact and Personnel Information — including names, job titles, phone numbers, and email addresses of employees, drivers, dispatchers, and other personnel associated with Customer operations. Communications Data — including transcripts of voice calls, recorded or transcribed dispatching instructions, driver communications, and messages exchanged through or processed by the Service. We process this data as a data processor acting on behalf of our Customers, who serve as the data controllers for their respective data.
3. Data We Collect Through the Website
When you visit materialmotion.ai, we may collect the following: Information you provide directly — When you submit a form on the Website (such as the "Start the Conversation" contact form), we collect the information you enter, including your name, email address, and message content. Cookies and tracking technologies — With your consent, we use cookies and similar technologies to understand how visitors interact with the Website. We currently use HubSpot analytics, which sets the following cookies: hubspotutk (unique visitor identification, 6 months), __hssc (session tracking, 30 minutes), __hssrc (session source reference, session), __hstc (visitor tracking across sessions, 6 months). Automatically collected information — Our servers and analytics tools may collect technical data such as your IP address, browser type and version, device type, operating system, pages visited, time spent on pages, and referral source. This data is collected only after you provide consent for analytics cookies.
4. Cookies and Your Choices
We use a cookie consent banner on the Website. When you first visit, non-essential cookies (including HubSpot analytics cookies listed above) are not set until you click "Accept." If you click "Decline," no analytics cookies are placed. Service data submitted by Customers is used solely for delivering, operating, and improving the Service; powering intelligence infrastructure capabilities including communications intelligence, scheduling and logistics optimization, and predictive operational models; providing customer support and troubleshooting; and meeting legal or contractual obligations. Website data is used for responding to inquiries submitted through the Website, analyzing website traffic and usage patterns to improve content and user experience, and sending marketing communications to individuals who have opted in (you may unsubscribe at any time). We do not sell personal data. We do not use Customer data to train general-purpose AI models without explicit written consent.
6. Third-Party Subprocessors
To deliver the Service and operate the Website, MaterialMotion uses third-party platforms that may process data, including: AI inference providers (natural language processing and AI-driven logistics intelligence), voice transcription providers (speech-to-text transcription of dispatch communications), semantic search providers (vector search and retrieval for operational context), application hosting and workflow providers, HubSpot (website analytics, form handling, CRM), and Framer (website hosting). Specific providers within each category are subject to change. A current list of named subprocessors is available upon request. Each subprocessor is subject to their own privacy and data protection policies.
7. Data Retention
Service data: We retain Customer data for the duration of the active engagement or as otherwise agreed in writing. Upon termination or written request, we will delete or return Customer data within a commercially reasonable timeframe, subject to any legal retention requirements. Website data: Contact form submissions and associated CRM records are retained for as long as necessary to respond to your inquiry and maintain the business relationship. Analytics data collected through cookies is retained according to the cookie durations listed in Section 3. You may request deletion of your website data at any time by contacting us.
8. Data Security
We implement reasonable technical and organizational measures to protect data against unauthorized access, disclosure, or loss. These include access controls, encrypted data transmission (TLS), and reliance on the security controls of our SOC 2-certified or equivalent subprocessors.
9. Data Location
Data is processed and stored primarily in the United States. By submitting data to the Service or the Website, you acknowledge that data may be transferred to and processed in the United States.
10. Customer Responsibilities
Customers are responsible for ensuring they have the appropriate rights and consents to share data with MaterialMotion, including any personnel data. Customers should not submit data that is subject to heightened regulatory requirements (e.g., HIPAA, export-controlled data) without prior written agreement.
11. Your Privacy Rights
All users: You may request access to, correction of, or deletion of personal data we hold about you. You may withdraw cookie consent at any time. You may opt out of marketing communications by using the unsubscribe link in any email or by contacting us. We will respond to verifiable requests within 30 days. EU/EEA visitors (GDPR): You have the right to access the personal data we hold about you, request rectification of inaccurate data, request erasure ("right to be forgotten"), request restriction of processing, data portability, object to processing based on legitimate interests, and lodge a complaint with your local data protection supervisory authority. Our lawful basis for processing is consent (Article 6(1)(a) GDPR) for analytics cookies and legitimate interest (Article 6(1)(f) GDPR) for responding to inquiries. For Website visitors, the updated policy will be posted on the Website with a revised "Last Updated" date. Continued use of the Service or Website after notice of changes constitutes acceptance.
